Supplier Code of Conduct

At MÜNCHENSTIFT, we are strongly committed to ensuring that the care and assistance services we provide are carried out in a manner that respects human rights, the environment, and the fundamental dignity of workers. That is why we only work with suppliers who are committed to the same principles.

We value our relationships with our suppliers and are committed to fair, open and transparent dealings with them. In return, we expect our suppliers to share our commitment to ethical, safe and responsible business practices. We expect our suppliers to work with MÜNCHENSTIFT in accordance with the principles set forth in this Supplier Code of Conduct. We also expect our suppliers to implement and promote the same principles in their own supply chains.

We expect all products supplied to us to be manufactured or produced in accordance with this Supplier Code of Conduct. We also expect all suppliers of goods and services to comply with this Supplier Code of Conduct, even if it exceeds the requirements of applicable law.

We expressly reserve the right to amend this Supplier Code of Conduct at any time as necessary based on our periodic risk analysis.

Our Expectations

In applying this Supplier Code of Conduct, we expect our suppliers to adhere to the following principles:

Child Labor: We condemn all forms of child labor. We therefore expect our suppliers not to employ children below the age at which compulsory schooling ends according to the law of the place of employment. In any case, the age of employment must not be less than 15 years. In addition, we condemn the use of children under the age of 18 for the following activities:

  • All forms of slavery or practices similar to slavery, such as the sale and trafficking of children, debt bondage and servitude, and forced or compulsory labor, including the forced or compulsory recruitment of children for use in armed conflict;
  • Recruiting, procuring, or offering a child for prostitution or for the production of pornographic performances;
  • Recruiting, procuring, or offering a child for unlawful activities, in particular for the purpose of obtaining or trafficking drugs; and
  • Work which, by its nature or because of the circumstances in which it is carried out, is likely to endanger the health, safety or morals of children.

Forced Labor: We condemn all forms of forced labor, including any work or service that is exacted from a person under threat of penalty of any kind, and for which the person has not volunteered, such as those resulting from debt bondage or human trafficking.

Slavery: We condemn all forms of slavery, slavery-like practices, servitude, or other forms of domination or oppression in the workplace, such as extreme economic or sexual exploitation and humiliation.

Occupational Health and Safety: We condemn the disregard of occupational health and safety obligations under the laws of the place of employment if this results in the risk of occupational accidents or work-related health hazards, in particular by

  • apparently inadequate safety standards in the provision and maintenance of the workplace, workstation and work equipment,
  • failure to take appropriate protective measures to prevent exposure to chemical, physical, or biological substances,
  • failure to take appropriate protective measures to prevent excessive physical and mental stress, in particular due to inadequate work organization in terms of working hours and rest periods, and
  • inadequate employee training and education.

Freedom of Association: We oppose any violation of the freedom of association. All our suppliers are required to respect the right of their employees to form or join trade unions and not to use the formation of, membership in, or affiliation to, a trade union as a reason for unjustified discrimination or retaliation. In addition, all our suppliers must respect the right of trade unions to operate freely and in accordance with the laws of the place of employment.

Discrimination: We treat all people equally. We reject any form of unequal treatment based on national and ethnic origin, social background, health status, disability, sexual orientation, age, gen-der, political opinion, religion or belief, unless it is justified by the require-ments of the job. In particular, unequal treatment includes the payment of un-equal remuneration for work of equal value.

Payment of fair Wages: We reject any withholding of a fair wage. A fair wage is measured by to the minimum wage required by applicable law in the place of employment.

Environmental Damage: We expect our suppliers to counteract harmful land degradation, water pollution, air pollution, harmful noise emissions, or excessive water consumption, that

  • significantly degrades the natural basis for food preservation and production,
  • deprives a person of access to clean drinking water,
  • impedes or destroys access to sanitation or water supplies, or
  • harms human health.

Respect for Land Rights: We condemn all forms of unlawful displacement and support the prohibition of the unlawful taking of land, forests and waters for acquisition, development or other uses that secure people's livelihoods.

Use of Security Personnel: We will not hire or use private or public security personnel if the lack of company direction or control over the use of security personnel,

  • violates the prohibition against torture and cruel, inhuman or degrading treatment,
  • results in injury to life or limb, or
  • interferes with freedom of association and freedom of choice.

Environmental Conventions: We expect our suppliers to comply with the provisions of the Minamata Convention on Mercury, the PoP Convention on the Treatment of Persistent Organic Pollutants and the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal in the course of their business activities.

Implementation of a Management and Control System

MÜNCHENSTIFT expects its suppliers to implement a management system to achieve continuous improvements and to ensure compliance with the applicable laws and this Supplier Code of Conduct.

In particular, we expect our suppliers to have designated representatives who are responsible for implementing management systems and programs and monitoring compliance with applicable laws and this Supplier Code of Conduct. Management must review and evaluate the quality and effectiveness of the management systems and programs at least annually and on an ad hoc basis. We also expect our suppliers to implement a process to identify human rights and environmental risks in their own operations and those of their direct and indirect suppliers related to their operations and labor practices. In addition, management must develop appropriate processes to manage the identified risks and ensure compliance.

Finally, we expect our suppliers to implement appropriate training programs for their employees to implement the standards of our Supplier Code of Conduct and to comply with applicable legal requirements. Where necessary and possible, we will assist our suppliers in providing the necessary training.

Speak Up!

Our suppliers are required to appropriately publicize our anonymous complaints procedure for reporting human rights and environmental abuses to their own employees and to their suppliers, and to encourage anyone who may be affected to report violations of this Supplier Code of Conduct.
